Definitely a Mot fail. I’ve seen ladders that have a large aperture where the number plate is so not obscured.I was just reading on a Land Rover forum Phil that a ladder obscuring a number plate is an MOT failure and an on the spot fine.
Might be worth looking into and maybe swap sides for the ladder and spare wheel? You could of course move the number plate but then the recess and light wouldn't look right.

Once the VBAir Suspension is installed it will be 30mm taller and I will be able to take it higher in off road mode.On the way home from Hereford you drove past me, your van does have a good 'road presence'
