This business of roads maintainable at public expense is quite obscure.

As far as I can make out, for the purposes of vehicle licensing, a 'road maintained at public expense' is defined in the Highways Act 1980. That Act is itself quite complex but it does require local authorities to keep a list of all such roads. The list must be freely available for consultation.

So, in theory at least, it should be possible to check the list at the local council offices to find out whether any particular place is in fact a road maintained at public expense.

A complex Act indeed - but it states that a "highway" may be maintained by the local authority as a footpath or bridleway and yet be used by vehicles. Sounds to me like a catch-all!
 
good homework could be the answer here. got to be worth doing it. .. authority always tries to bully you . ask loads of questions with every body. if you give in now you have lost. keep looking for info.
along the way you find alsorts of things out you didnt know before. cheers alan.
