Steve, you could try ringing the environmental health department within the local council. They will get involved in noise and anti social issues, your problem may well fall under the latter category.
Also worthwhile keeping a log of all events.

I have logged and photographed everything, saving all emails, texts and a Google Notes file of the various exchanges. The Duty EHO rang me back this afternoon to confirm that she will pass my latest concern [refusal to confirm that the upstairs flat has repaired the leak, becuase they haven't and lied to the EHO Case Officer] for investigation. She suggested that I leave it to the EHO to deal with next week

In Scotland, the purchase of a 2nd property, irrespective of the reason attracts an additional Land Tax of 5% of the purchase price. You can apply for a refund if you sell one property within 3 years. Our upstairs neighbour ignored my warning in early May about his dripping shower leaking into our bedroom ceiling. When we got back from France in mid-July, the leak had spread, loosening plaster and producing heavy black mould spores [not good to breathe, especially after a heart attack, a mini-stroke, and 2 pulmonary embolisms].

It's estimated that the wall will take about 10 months to dry out properly, and then the replastering can start, so probably 12 months in total [assuming the total onanist actually gets the leak fixed ...]. We are going to purchase a small property, rather than risk a fatal dose of mould spores, but we will have to pay the tax AND take a mortgage on, because we will not be able to sell the flat until the repairs are finished. Still have to pay the Tax and the Interest, and I'm not allowed to shoot the worthless piece of excrement in the upstairs flat. Suing him will be a waste, he's a scaffy git with insufficient money to repair his rotting windows who took over 6 months to get the money together for his retrospective Planning Consent [another PITA]. I think I should be allowed to shoot him under a Pest Control Licence and claim a Government bounty upon production of the rotting cadaver ...

If you claim off your insurance your insurance company may well go after him to get their money back unless of course his insurance is paying. If it is fill your boots and find a hotel.

Until I hit 80 we ran everything ourselves,I did maintenance and the boss did the finances.
When 80 came along we handed our portfolio over to a local recommended estate / letting agent.
For a small fee, percentage, everything is taken care of, including the collection of the rents.
So far so good.

1.Have you made any claims in last 5 years?
2. What was cause? Pre-filled menu gives 'Water Escape', without any ability to specify that it was the neighbour's fault
3. What was the cost?

And then the Mickey Mouse quotes arrive, and the list of companies that won't quote could fill a book ...

In which case it's time to visit a high street broker, they still exist down here, most are specialists, so pick a house/property one and they should be able to get a proper quote for your circumstances.

A lot of the English Brokers are web-based, Kev, and come up with the same Claims History question when searched onine for 'Listed Buildings'. Aviva have a stranglehold on the market, and they will provide 90 days Unoccupancy Cover for John Lewis & M&S customers, but not for their own clientele. The 'Tailored Cover' companiesstill apply the same Claims History criteria/questions and there is no option to clarify that it was the morons upstairs, rather than yours truly, who caused the damage. The Industry is operating a scam by effectively removing 'Liability for damage to 3rd Parties' payouts, unless you kill or maim said 3rd Party

The answer may be to let our property to Tommy Robinson and his supporters for a weekend beside the sea. At least the upstairs neighbour would know what it feels like to be on the receiving end of anti-social behaviour. On reflection, a report to the Police on suspicion that his Campervan Scaffy Wagon in which he transports his 'tatting' goods is not insured for business goods carriage might be easier; and following that up with a report to Revenue Scotland for tax evasion by buying the property in his partner's name, whilst the Edinburgh property is in his name, avoiding the 6% Tax on the 2nd property, some £11,700 ...

He's also got a retrospective Planning Application in, Neil and we have lodged objections, pointing out the lies he has told/lies by omission by our sending date stamped photos taken on the same day as his, but a couple of hours earlier, to prove that the hole in the roof of the garage was made by him with a sledgehammer ... And, even if the 16ft x 8ft x 8ft garage was dangerous, replacing it with a 13ft high structure that has a footprint of 16ft x 25ft is not a 'replacement'. He does make a 9 bob note look kosher
