BBC News - Councils lobby government to raise parking fines

Just back from three weeks in Spain, Portgugal and France and apart from the big cities you can virtually park anywhere and for as long as you like and not have to worry about being clamped, fined, towed away, etc. I was in Beaulieu in the New Forest last weekend, just wanted to stop to go into a shop, and I ended up reading all the signs to work out if, when and how long I could stop for. What is it with this country? Maybe it's too crowded. :mad:
 
city,s,towns and villages ,lane's,streets and roads are more or less same as they were years ago but now nearly everyone over 17 as a car that they would go in for a sh!te if they could,school holidays and our local roads are empty whats the catchment area for a school, does every child need to ride in a car to school,when do you ever see a park and ride overflowing ect so yes we are over crowded
p.s.when i started work in 1964 the bike sheds were bigger than the car park by 1973 they had tarmaced a 4 acre car park and on day shift you had to be early to get a parking place
 
As far as I can see there is not a stretch of road that I know of, that has not got double/single yellow lines. Even in quiet villages you come up against them. In 5 years in England, on the highway, I find there are very few resting places. Where I come from, Germany, there is a rest place every 5 KM, and major rest stops every 20 to 30 Km's, occassionally, you may have to travel a little further. And, you can stop for as long as you wish without being charged.

Never a true word said. It happens all around the world, but forgive me for saying, in Britian it is extreme. The Country is beautiful, shame the politicians have brought it to this level. I hope I have not stirred a hornets nest.

Local Politics

I think its the system of local politics in England. Parking fines tends to raise income from those outside the voting area. For the same reason its very difficult to get new housing built for people outside the electoral area, Local Government acts in the interest of local voters, rather than the country as a whole.

It's sad but true that for a number of reasons anyone with any money, nous, aspiration etc are leaving or have left the uk for if not a better standard of living then for better weather and a more convivial atmosphere in various parts of the world.
The only social advantage to living in the UK is the so-called Welfare State but if you fulfill the previous criteria then that hardly matters and is being slowly dismantled anyway.

My wife has recently had need of the Spanish health system and I am very impressed. We have a friend back in England who is also in need of the same minor operation but who has had to wait a lot longer than Jenny at every stage in the process. As EU citizens we are entitled to use the Spanish health system but I was interested to see notices all over the hospital which say "REGARDLESS OF YOUR LEGAL STATUS, EVERYBODY IN ANDALUCIA IS ENTITLED TO FREE MEDICAL TREATMENT". So even if we weren't EU citizens, they would have treated her. We are constantly being told that Spain is next on the list of Euro zone countries about to collapse yet the hospitals are clean, well-equipped and efficient, inflation is much lower than at home - and you don't have to pay for car parking - even at hospitals! My question is - if they can bloody do it, why can't we?

There is no law saying you have to pay parking fines,if you ever get one send it back asking for a contract and a bill of sale ,it normaly stops them in there tracks as a parking ticket is an act not a law and most people don't realise this.If you look at youtube and type ( unlawfull parking tickets ) you should pick up on the idea,cheers Shawbags.

This is very misleading advice. Parking fines ARE legal but there are ways of beating the system. Asking for a "contract" is not one of those ways - fines are not imposed by agreement! You have to find a loophole such as the time we were pulled up by a speed camera and issued with a fine. We asked (as is our right) for a copy of the photo, which was of the rear of the van and therefore didn't show the driver. We wrote back saying that we couldn't remember which of us was driving and they gave up because they knew it would cost them more to pursue it than they would get from the fine. If you want to find a loophole then one of the best websites is www.moneysavingexpert.com/parking - but don't get bogged down in all the "an act is not a law" stuff which is legal nonsense.

Thought i'd add my shillings worth..... having lived in Germany, Holland and Belgium I am appalled at the greedy, penny pinching, tight fisted and unfriendly way motorists are targeted in UK. Not only do we pay the most in road tax, fuel, insurance, parking fees etc it is also has the most expensive camping sites, no legal wild camping (as far as I can work out) and is the most motorhome unfriendly country in Europe. Roll on 2011 when I go full timing......not in UK!

Hi John H,i have known of a few people who have been in this situation and it has worked and as for getting bogged down i don't,you are right about asking for a photo but i have heard of registered owners of cars being persued for the cost of the fine even when they have said they could not remember who was driving,if they want to push it they will no matter how you try to get out of it.This is one of those subjects that could go on for ever,i have known of a person who went to court to stand against a trafic offence and was found guilty,when he recieved the court paperwork even though his case was seen to at 2pm the paperwork had been signed at 10 am on the morning thus the dicision had been made four hours before he entered the court,cheers Shawbags. P.S do you have a legal background ?.
 
Absolutely right that they can push it however much you try - and I wasn't trying to say that the trick we used would work every time, I was just saying that using the "statute isn't law" argument is really a non-starter and people would be better off using websites like the one I recommended (ie use the law against itself). As for my legal background, I am married to a solicitor - but you do not need any legal background to know that acts of parliament are laws in this country and that there is no contract involved between the people issuing the fine and those receiving it.

Surely that would be grounds to win an appeal....:confused:

They got to get the dosh somehow....:mad:

Hi again,i have been reading some of the TPUC.org posts take a look and give me your opinion,i do disagree with the way the law in some cases takes the p*~s but i truley believe that without the law this country would be in ruins so any help would be gratefully recieved,out of interest can you tell me if it is law that i must give a police officer my name if they have no reason to believe i have commited a crime,cheers Shawbags.
