brakes not as exspected

Hello,on its second mot 5000 miles since bought the rear brake pads and disks have failed the salesman told me when i initialy complained on the test drive that allthe pads and disks were replaced new but this was only done on the front which are pristine compared to the rear what recourse do i have he hasreriously mislead me and that was the clincher for me buying it as i told him i would want to check all brake pads and disks before purchase .
 
I suspect none! Brakes and pads are a consumable item. Did the salesmen actually list that the pads and discs had been replaced.

he just said it verbally when i was in the process of buying it on the test drive the brakes were rubish the salesman said he would get them seen to i told him that i would be checking everything out before purchase
but the motorhome was in the workshop untill late and as we were a distance from home i took his word when he said that all the disks and pads back and front were renewed and i completed the sale,nothing in writing.? the servo needs replaced as well on tis first mot with them it flew through with nothing said a
bout the brakes. have i any legal recourse. its on their computer that the front pads and disks were renewed but he specificaly said all were done.
 
My gut feeling is that if you'd checked them when, or even immediately after purchase, you may have some sway. However, not picking it up until 5000miles later, I'd say little chance at all.
 
Salesman tells you what you want to hear shocker????

The only way to be sure of these things is to check them with your own eyes.
 
It is better to put it behind you and take it as a lesson learnt, pay out and just enjoy using the van

You didnt say why the rear brakes failed the mot can you enlighten us please ?
 
I realise that 'cheap' and 'easy' are both very subjective words. However, changing the rear discs/pads is a pretty cheap and easy job.

I don't think there are many motor-homes with 'pads' at the rear???
 
If the agreement to fit new brakes all round wasn't recorded in writing then you are wasting your time seeking any legal recourse.
If the servo is on the way out then that is probably why you had poor brakes on the test drive.
If your van is a diesel, a knacked vacuum pump may also give similar symptoms to a failed servo, as would a split or collapsing vacuum pipe.
 
A few years ago we brought a motorhome from a dealer in Bury, when I was collecting the vehicle I noticed a very small crack on the inside of the front roof light so I pointed it out to the sales man who told me not to worry as the van has a 3 month warranty and if it gets worse let him know. 2 Months later the crack became 100mm long overnight, so next day called the dealer who then went on to tell me that windows are not covered under warranty and he never said it was covered , I found out I did not have a leg to stand on re suing them, silly me for not getting it in wrote down and it cost £1500 to replace. Anyhow since then we have spent over £90000 on purchasing different motorhomes until we found the layout we want, and guess were we did not spend the money :tongue:

The rear disks were scored and pads worn down as for the handbrake it has seperate drum brakes and shoes which are ok the mechanic said on the rolling road he had to pull handbrake up fully and the pedal went to the floor when i drove it there the pedal was fine and as for the handbrake on a steep hill half way up was enoughto hold it i am very fastidious with my brakes and never hammer them there is no way the rear disks and pads could wear like that as the front disks and pads are pristine if i was hard on the brakes they would be worn i have had vehickles for 10 years on the original clutch and brakes he told me all the disks and pads were renewed this is what swayed me to fianalise the sale i had issues with the habitation check and they put it in writing that they would put right any high readings that would not go away as it had been on the forecourt for a while the saleman knew i was buying from a dealer and paying a bit more to get a decesnt vehicle on the test drive the pedal went to the floor and i told him i would be giving everthing a check over before purchase particularly the disks and pads but they kept the vehicle in the workshop all day and the salesman stayed behind after hours to complete the sale when he said all were renewed i took his word as they gave me in writing about the habitation check and i thought they were as good as their word they are a big company and a bunch of crooks .

it is a mercedes autotrail scout and the rear disks have drum brakes for the handbrake built in
 
Hi when did you purchase this vehicle 12 months ago ? Just going off it having gone through 2 mot's

Its the principle of the thing he deliberately kept the vehicle in the workshop until all the staff were away and i would not be able to look at it up on the ramp or inspect it properly he manipulated the situation because i told him my intention to check it all over i had been in contact all day and pretty tired later at night we should have a named and shamed for these companies and salesmans blacklist.
 
I think you will find all motor co work moves and when i worked the trade most were at it,in fact every ones at bad practice like my insurance pension who will not be paying out what they said they would,so all in all move on and just enjoy the van never mind the bits and bobs it requires along the way.
