We hired a Motorhome from Avondale Motorhomes of Tingley, near Wakefield.
On returning the vehicle, the owner deducted £35 from our bond, despite 4 of us cleaning the vehicle from top to bottom for 2 hours prior to its return.
Not only that, at speeds of 60mph, the vehicle shook violently.
The TV, DVD and reversing camera did not work.
We had to fix the bed.
The leisure battery did not work.
The tanks would not hold water.
Water poured in through the roof.

It is our belief that, this company is now selling motorhomes, due to our past experience, I would not recommend this company as your next dealer to part with your hard earned money.

Good that you got your money back.

Forum owners generally appreciate it if you just stick to the cold hard facts as established by the court rather than embellishing your story with defamatory remarks. Because you don't post under your real name, it could be that the forum owner gets to have his day in court defending himself against your actions.

Good point, I will gladly supply my details including case number to the owner of the site if he so wishes, I would not expect the owner to suffer loss due to my postings here.
What I am really interested in though is your comment regarding defamatory remarks.
What you have to understand is, I went to court with the opinion, clearly set out that Avondale had lied to me and what I actually said was "STOLE" money from me. The Judge agreed.
If the judge agreed that he stole money AND lied, then the law agrees therefore how can he claim any deformation when the law is against him?
Do you see where I am coming from now?
 
I can certainly understand you wanting to warn others, but while there may be some justification for you to relay the objective facts regarding the case and its outcome, where the problem may arise is you extending the court's finding on one specific case to state unequivocally that the company is dishonest etc etc and strongly advising all and sundry not to deal with them. This gets into the area of causing, or trying to cause unjustifiable loss to someone by causing damage to their reputation.
Regardless of the rights and wrongs of this particular situation, I really can't agree with someone (anonymously) using any forum as a weapon of revenge, especially when you have had your day in court and been lucky enough to win.

My attitude comes about from experience with my own forum where a member made what were regarded by another member as defamatory statements and I ended up being the one the lawyers went after on the grounds that I was in law the publisher of the defamation. The action didn't have a snowball's chance of succeeding, but it caused me more than enough hassles regardless.

To say they can't be trusted now, could be perceived as defamation.

But it would be truer to say you did business with them, they were found to be dishonest in court and you wouldn't personally do business with them again. I know it's a small difference in emphasis, but that's how these legal things go!

I hope the people who read it realise that reputable dealers can be found elsewhere around the country.

This can be summed up with the words 'Caveat emptor', 'let the buyer/hirer beware'

My friends and I have had similar experiences with Avondale & took them to court last year - we had judgement made in our favour £350 but are still waiting for payment. We are due back in court next week for Avondale to put the case why the judgement should be set aside - will let you know how we get on. Have you actually had your payment & did Avondale bother to attend court ?

Hi, Yes he did turn up. He asked for the case to be appealed. The judge refused.

If someone has a Judgement against them and they fail to pay, you can apply to the Court for the Baillifs to enforce judgement and seize goods for auction to pay you.

They also get the Baillifs additional costs added to the debt

well his application to set the judgement aside was thrown out and we successfully applied for additional costs of £60 the payment was due within 7 days but i dont expect it's arrived yet. We are thinking about bailiff action as our next step although he insists he rather than Avondale owns the vans... but we'll see we've got so far why would we stop now it's getting to be a matter of principle.
