Anybody taken a dealership to court

Long shot has anybody taken a dealership to court over a caravan that was sold that wasn’t fit for purpose.. sold under false advertisement. Brought less than 2 months ago
been a dealership you trusted them they then admitted to get the repairs done properly and then it’s just lyes. Dropped it off at the dealership who then took it to the chosen place to fix the damage. I then asked numerous times for the details who was doing the work.
I finely get the details to which I call them to say I’d be round to see it and Then the van suddenly gets stolen from the repair shop ( that actually wasn’t a specialist) who had actually failed to even start any of the work. Yet they informed me work was well under way.

How do I know they hadn’t done anything… I got the caravan back


There’s a lot more to this thread but i don’t want to go into full details at this stage as im just looking for advice on a procedure/ solutions.

Any recommendations on a legal representation at all?

LBC have two phone in programmes on Friday and Saturday evening at 9pm for one hour.

Friday evening assists with consumer/customer issues.

I suggest that is worth a try for some professional guidance.
 
You have 30 days from the purchase date to reject it and ask for your money back. After that things change and you have to give them the opertunity to repair it. If they don't repair it satisfactorily after the first attempt you can reject it. It all gets very complicated and a solicitor will cost you an arm and a leg. You are also going to need an independent surveyors report to back up your claims. You cannot just say its not fit for purpose you need proof. I took our local Dealer to Court because I fixed it a darn sight better than they did. I wrote to them and sent a detailed invoice listing all the work and time taken and gave them 14 days to pay it. I also put in the accompanying letter that I was happy to go to court to get it sorted. They passed the letter to Swift expecting them to pay it. Swift replied I had modified the vehicle so warranty was voided. Local Dealer then refused to pay so just filled in the Small Claims form for an unpaid invoice and sat back to see what happened. Took them 10 days to reply after they received the paperwork. The directors had agreed to pay as a goodwill gesture. I also got the £80 Court fee as they had left it so late. Do your research first. You can get 1/2 hour with a solicitor for free. Citizens Advice may help log everything. Dont discuss things on the phone unless you record the conversation and you have to tell them you are recording it. Send important letters recorded. Keep all emails. You need a time line in case it finishes up in court. Also take screen shots of everything that maybe of use before its deleted. Rest assured they will have done it before. You won't be the first and they will know all the tricks. First one being to get you past the 30 days which they have already managed to do without you even knowing it.

1 that a few of you have mentioned is the 30 day rule.. I was aware of this and I already told them I could return it.. there reply was it will be repaired and done properly, im not out to con anybody.. at this point I took his word and it went back in for the repairs just on the 30 day line.. after them having it for 2 week it was then stolen… I found it and got it recovered as they wasn’t interested in helping. It’s not going back as i don’t trust him.

Every word from the dealer is all recorded and have photos of damage and him confirmation of it will be repaired correctly and professionally..
van is booked in for a report at a local specialist next week. Then il start legal action’s

Brilliant. Plenty of ammunition there. We'll done. Perhaps a carefully worded letter from a Solicitor will be enough to sort it out. Good Luck. I was upset when the Dealer paid up. I was really looking forward to making them look like right plonkers in court 😞
