Good news.

As of today, wheel clamping on private land has
been outlawed in England and Wales!

You can still be ticketed, but that gives you a
chance to choose whether to challenge it or
not, rather than being subjected to a forcible
protection racket.

It's nice to see that the government have
actually followed through on this item from
the "Freedom Bill".

P.S. Just one note of caution:
Some little known by-laws do exist
which give certain landowners the right
to manage their parking in any way
they choose.

For once, a victory for the Motorist!

All the best, Graham.

I think there was another change that went a bit unnoticed, the Department for Transport is also strengthening laws around ticketing so charges can be claimed from owner and driver. Whereas before it was the driver who was responsible.

I have never clamped on the bit of land that I own. I have a large steel gate which gets locked. The charge for unlocking the gate is 25 pound at the moment.

Really good news my son was clamped while in University and they would not release the car until he paid.
We tried to complain and get a refund but they would not even reply.
Was in Staples car park My family and I have never been in the store since.

But no method of release is good enough while I have you on CCTV and then go to court for the damage to my property. I know I have been down this road three times in the last 10 years. Just fed up with peasants who think that any land with an open gate is theirs do do as the please with. I wonder how they wpuld feel if I parked on their drive for a few hours?

My daughter lives and works at her house. Next door to a bank, people are always parking on her drive to go to the bank, if I'm there I pick there car up with her fork lift truck, move it park another old car in front with its wheels of and when they come back tell them I'm repairing the car and it will take me two days to finish:) they don't like that. :mad1:

For those of you advocating other means of immobilising vehicles please note that the principle behind removal of clamping includes all means of immobilising vehicles and demanding payment. In Scotland it has long been classed as Extortion - a criminal offence.

sorry but they have tried this with me in the past and it don't work. I have a right to lock my premices and charge payment for unlocking them. I challenge anyone to try.

You would rely on CCTV being accepted for a positive ID and go to court to claim the price of a padlock?

I would on principle. My daughter lived next door to a bank and people constantly used her drive so she couldn't even get out. Their usual excuse was "I'll only be 10 mins".

Multiply that by everybody else all day and it is a major problem, mainly down to ignorance and arrogance.

You could just lock a stinger device across the entrance, or a removeable locked post, or just a simple gate.

Yeah but she shouldn't have to do anything! Anyway she's moved now so no longer a problem.

Thats what they used to say to my daughter, but not any more. Get her to try my "trick"

We have the same problem in city centre. We are the only business in the area with a private car park. We have a Grills for Teeth ( Yuk ) next door which attracts some very unsavoury low life who think they can just park where they like. So we lock the gates. They have now started parking between the gates so we cannot lock them but it also means we cannot get in and out. Police are not interested they just say it's a civil offence.

iv always used the compressed gas sticker approach as i am under the impression that a vehicle with compressed gas on board and appropriate sinage cannot be clamped
