Expensive mistakes

Last September, I part exchanged my Autoquest for the Burstner at Discover Leisure, Birtley.

I filled in my part of the log book and was going to tear it out and postit to the DVLA. The salesman said don`t bother, we will send it off with the Burstner log book in our company mail.

I agreed. That was mistake number one.

In November, I got the reminder to tax or SORN the Autoquest. As I was no longer the owner, I binned it. That was mistake number 2.

Now, I have to pay a fine of £80 or £40 (for early settlement) because I did not tax it or SORN it.

Always make sure you personally post the change of ownership (and get proof of posting).

If you get the reminder to tax the vehicle then the same thing is happening to you. It will probably be simpler to SORN it and return the form to DVLA.
 
So what did Discover Leisure, Birtley have to say about this?
 
I had a a similar thing when i went to tax my tribute on monday,the guy in the post office said there was a month missing and the tax had run out at end of december.He did not believe me when i said it only run out on sunday and i had to get my old tax disc off windscreen to prove it.After much discussion he eventually taxed it but said i would have to inform D.V.L.A otherwise i would get a £60 penalty for an untaxed vehicle:confused:(But i got a tax disc to prove its taxed:mad::mad:)After a phone call to D.V.L.A they say as someone surrendered the old tax disc(cant tell you who:eek:) it cocked the system up.Advised as now have tax disc nothing will be done this time:eek::eek:,not an apology to say it was incompetance on their part.And was then told to ring the Preston Enforcement office to explain to them just in case the send out penalty notice.:eek::eek:So who pays the costs when i dont pay the fine and am taken to court for non payment:confused::confused:

Did the same a few years ago when I part exchanged an old Renault, the garage offered to post my section of the form.
Over the next 4 months I got speeding fines, parking tickets, all from the London area, The Met police were very good once I explained and got the local useless plod to follow it up, it turned out the garage had been taxing the PXs then selling them in the London area at a premium. A taxed old car means that you dont have to bother with insurance, or worry about speeding, and get clamped then just walk away and buy another old taxed car.
Not a mistake I will make again.
 
Most responsible garages will complete the px'd to a dealer part of the v5 and give it back to the customer to send to dvla because of the frequency of dvla to issue fines.

In respect of discover leisure, it doesnt for a moment surprise me.

Their MD Trevor Parker,and I am lead to believe fellow interested parties Simon Dixon And Paul Dixon I had the misfortune of working with in a past life.

Dixon motor Group in its various guises they were involved with.

It does say on the V5 that you are liable until they are informed you no longer own the vehicle. I always make sure I send my bit of the V5 off myself, when I sold the last van I offered to send the buyers bit of the V5 but they declined (don't blame them would rather they did it anyway).

Many years ago I remember getting a letter about illegal parking for a car I had part exchanged about a year earlier. I was able to sort it out with a phone call at the time, since then I don't take chances.

It was even worse when we lived in the USA, if you bought a car there & there were any outstanding fines or their equivalent of the road tax hadn't been paid you were liable, you bought the debts as well as the car.

This is exactly what happened to us, and worst of all the Bailiffs are from Yorkshire!! tight gits:D or so people tell me;)

When I got on to Discover Leisure, they naturally sounded flabbergasted and swore blind that they had sent off the paperwork.

I have to take that at face value as I cannot prove otherwise. I sent a copy of the Invoice from the purchase with the dates on and got a letter back saying I was still liable for the fine.

The DVLA now know that Discover have the vehicle but they will not get any sort of fine. They should have sent another section of the V5 off to say it is in trade. If that does not arrive at DVLA, is there a penalty for that? I doubt it.

It looks from your post that you have been well and truly shafted a very costly lesson learn't. And that is not fair!!!!!:mad:. I would suggest that you take your whippets up there and give them a good drubbin!!!!;) and while your at it give them one for me as well :p. on a serious note I would have thought that as you could prove that you did not own the motorhome at the time you should be free and clear!!!. However the problem is of course that as far as the DVLA is concerned you are in the wrong not them or the dealer which of course again is wrong. It just goes to show what dealers do just to get a sale!!!:eek:. All I can say is keep fighting and don't let them get away with it!!!;).

speak to discovery about them paying the fine less you and others(namely us :)) will go down and have a protest outside their premises putting potential buyers off! surely be cheaper to accept their measley mistake than to lose one customer with big profit!!

Exactly, and hence the reason most garages at the point of handover give the V5 notification slip to the customer to send off to Swansea.

Thanks for the suggestion n8rbos but it would be a waste of time.

I do not think they have sold a m/home since I bought mine. They are absolutely packed with vans and caravans. Other dealers are desperate for stock because they have sold everything.

It has got so bad that I am losing my storage with them. They need the space, so about 50 vans and caravans are being turfed out at the end of February.

i woulnt believe a word they say ,rip off company bought new argos from them, first service they didnt fix a leak said they would need it in for a few days ,local dealer fixed it in30 minutes plus door handle was broken and the agro i recieved from them to get it fixed was unbelievable,no wonder their shares are worhless:D:D
 
We bought a new Romahome from Richard Baldwin in March 2007. We cashed in the tax and they sent off the V5 for our old camper (along with 5 others). Ours went astray and the first I knew was a fine for no tax or SORN. Many discussions with DVLA and RB including proof of postage ETC. DVLA would not budge. The outcome was that RB paid the fine without my asking and much grovelling from them - I was really impressed and it helps with customer relations.
 
Good result

I paid my £40 fine for not declaring SORN or taxing the vehicle I no longer had.
I took the receipt I got from DVLA and gave it to the Sales Manager at Discover Leisure. Without a quibble, he gave me £40 in cash and apologised for their mistake (as they offered to send off my part of the log book in their company mail).

I have to be honest and say that I have had no trouble whatsoever with the staff at this branch. They have been helpful and courteous and nothing has been too much trouble for them.

I did not try and screw them into the ground when doing a deal. This is often the reason that some buyers bad mouth dealers. They are just too greedy for their own good.

I am sure others will say different but I am satisfied with them.
