I bid and won an in car DVD player, but the seller has sent a message saying he has already sold it elswhere, and wishes me to cancel the transaction.
I have checked my bank account and the money for the item has been taken out.... is this a scam or is the money held by paypal until the situation has been resolved.
I have informed the seller that I will not agree to his cancellation until such time my money is back into my bank.
Is there anything else I can do?

Regards
Dave

My first guess would be that the seller didn't get as much for the item as he wanted, so is now trying to back out of the deal, pretending that he's sold it elsewhere. This only happens very rarely with a few bad sellers (have you read his feedback?).

You can contact eBay customer support (there's a link at the top of your eBay page). Or Paypal customer support is usually pretty helpful, and will make sure you get your money. You should find a link to Paypal on the lower left of your eBay screen.

Nobody can prove if he has already sold the item or not, but you shouldn't lose your money. I wouldn't cancel the transaction before you speak to eBay or Paypal.

Hi Dave
I agree with Scampa on this. I use to trade on Ebay for a living I think you may find in this case that the person who listed the item did not realise that he/she cannot 'pull' the item on certain catagories if it is within 12 hours of the auction ending. As Scampa said just get in touch with ebay/paypal and they will sort it out for you once they have had a complaint they freeze the sellers paypal account until its sorted
Bye for now

Go to the Resolution Centre on Ebay, you will find it via the 'Help' section. There you can follow their grievance procedures which might bring you some degree of recovery.

I don't use E Bay personally, but know lots who do, I keep hearing of problems that people have and often wonder if it worth the hassle, I know of one seller who has been banned recently for he suspects bad feed back I.E not responding to E Mail questions that he claims the answer to is in the original add. Also he supposedly overcharges for postage and packaging, but don't worry said E Bay, just set up another account with a different user / seller name and off you go, same E Mail address too so I wonder what other scams are tolerated on E Bay.

I have been buying stuff from Ebay for about 10 years now and have only had 2 problems in all that time. The first one, my husband closed down - bless him! The second one I contacted them and gave them 7 days to respond, when they didn't I took out a grievance and followed their procedure. I sort of got a resolution, but I wasn't expecting any.

If you have contacted your seller and asked them to refund your money, you have to give them at least 3 days to do this before you start the grievance procedure. If this amount of time has already passed then I would do as the others have suggested.

If the seller did not put in the original post that it was being advertised elsewhere, then they probably didn't and as Scampa says, they are probably trying to pull a fast one without knowing the rules.

Stay calm and carry on!

Cheryl

Thanks for replies...
Have contacted seller and ebay resolutions, seller has only 'sold' this one item.
I have been buying and selling from ebay for a couple of years now and had this one and one other case of someone using my account to buy a handbag (£400) which was sorted quite quickly, but I have not come across this type of situation, where the bidding has ended and I have won the item, but the seller has sold it elsewhere...

I had it happen to me a few years ago - luckily it wasn't an expensive item and the seller did the right thing in my case.

Unfortunately there are more of these scammers and also shillers :mad1: using Ebay now - Ebay and Paypal don't care about the shillers because they earn them more money, but scammers should be a different thing.

Lots of good advice above - good luck.

ps I have been using Ebay for nearly 10 years now and have had very few problems.

Like a few others on here, I've also been using Ebay for about ten years and have bought literally thousands of items, from nuts and bolts to cars!

A lot of folk still seem wary of using Ebay and there will always be a small few who will try and use it dishonestly. I have only ever had about half a dozen problems, and most of those have been sellers who have supposedly "lost" the item when my winning bid was too low for them, although I never lost money to them. One chap blamed his wife for donating a valuable book to a charity shop on the day before the auction ended!

The one serious problem I had several years ago was when I foolishly agreed to send a bankers draft instead of a cheque or Paypal payment for a very expensive camera from a private seller. The sellers turned out to be a group of scammers using false details that couldn't be traced. After unsuccessfully going through all of Ebays correct procedures, I sent the scammers, via Ebay, an email promising to involve the police and track them down personally. I guess Ebay were concerned about the bad publicity, because they promptly sent me a full refund as a "token of good will"!

You have to remember that an increasing number of sellers on Ebay are genuine long-established merchants who have their own stores, but use Ebay to reach a wider market. Living in a country area as I do, I find it's much easier, quicker and cheaper overall to buy even smaller items such as nuts and bolts, fuses or whatever via Ebay. Most business sellers deliver next day or within two-days at most.

Another advantage is that if I buy a larger item, where delivery isn't available, it gives me an excuse to make the trip in my van and spend a few days in the area! :):)

PS.... don't forget that it is possible the seller in the original post may have just made a genuine mistake!

Ebay scams

I have only two bad buys on ebay before Christmas for the last 15 years or so. Sadly I have had bad buys from sellers at least 6 times since Christmas, thankfully recovered all through Ebay or Paypal, that is except postage!
All the sellers on Ebay seem to be dealers these days and are required by Law to refund all including postage, yet many break the Law and don't refund postage!
China buys being front runner for bad sellers!

Yes, of course people make mistakes, but perhaps the seller could have sent me a message explaining his mistake with an apology, which I would have then accepted (with the refund). All I got was a message from ebay saying seller requests a cancellation because they have already sold it! Nothing directly from the seller. :(

Exactly - not ideal, but it would help............

Civility costs nothing!

motor home scam

I have been looking for motor homes for a while now, and during the last month of searching ebay, autotrader and gumtree I have found Loads of Van scams, the vans are always Bargains, pass all reg no. checks but all need to be paid for inadvance with the promise of delivery to your door, I am sure you are all far to savvy to fall for any of these, as I was, but hubby was nearly caught, he got really excited by one find. Remember if it looks to good to be true is prabably is. The police got involved in one of the scams which had really annoyed me because the seller was pretending to be in the armed forces about to be sent to Afghanistan........ needless to say the police wern't successful in catching anyone, As for me I have bought my Transit leisure drive from a Garage in the end, and I pick it up at the weekend, it exists and no money will be exchanged in advance. Happy Camping, and Ebay Shopping just remember buyer beware.
