Hi everyone just joined tonight and I have an issue with the law over sleeping in your motorhome while over the limit to drive - what is the law.
I was only using my van to tow my racecar and somewhere to stay trackside, now using it more for pleasure which has now included wild camping but I do like the odd glass of wine!

Aye no bother Lenny, I think if you have your keys for your van car or whatever at hand you will be prosecuted for being drunk whilst in charge of your vehicle:eek:

common sense applies here don't leave yourself open to prosecution
if you have corner steadies down you aren't intending to drive
if your drivers seat rotates spin it around
if you have one of the insulated screens on your windscreen use it
above all never have the keys in the igntion,put them in a cupboard away as far from where you are sitting
and if like me if you do get a visit from the police answer the door in spiderman pj's:D::eek::eek:,Andy.
 
hi and welcome to the best mad house around as for the old tipple or two:D:D never had any probs, dont think the boys in blue care realy. never been bothered by them wherever we have stayed
 
A good idea, if you are stopping at a pub stopover leave your keys in the pub.
Or if you have a partner that don't not drink or drive your van give them the keys.
better to be safe than sorry.
 
I saw on the TV about 2 years ago on something like "Traffic Cops" where somebody had turned up several hours early for his ferry and parked up in the car park and went off, which invoved a visit to a local pub. The parked box van created a possible bomb threat and the police wanted to search it. The driver has located and asked to open the doors. the next thing that PC Plod said was "blow into this" which was negative. Moral of the story is don't trust PC Plod. Obviously the driver had no intention of driving but they still wanted a sample! Best not to park up and drink.

If you answer "Yes, I am the driver" you are admitting to the copper that you are in control of the vehicle and can be tested. Fine line, but most law is about a line drawn by someone.

So when you say no does your partner say no, if nobody else
is in the van then who is the driver.

I believe the copper might be not too happy for the run arround:eek:
 
I suppose it depends at what point you are deemed to be in charge of the vehicle. If you have the keys then you are (in my opinion) in charge. if you swap keys perhaps you are not, but if you hold the keys to another vehicle do you then become in charge of that? As you are not driving the charge could not be of driving whilst intoxicated by drink or drugs, however you could be charged with the similar offence of being drunk in charge. But that is a charge we could all be under if we go out for a few with our keys in our pockets, in reality its less likely as more often the breathalizer would be used after stopping someone.
If you take the risk and get some jumped up pc knock on your door he could charge you, but then again what are the chances of that unless you cause a nuisance?

The thing is he would then have to prove who was, that would have to be done in court, I am Spartacus no I am Spartacus, I don't think he will crucify both of you's:eek:
