No. That's true. I'll throw my hat in the it's utter nonsense that you will get done for drunk in charge parked up in a motorhome pissed camp! Not had this old 'drinking in van' chestnut for a while
Being as Section 5(1)(2) of the Road Traffic Act 1988 creates a statutory defence of there being no likelihood of driving the vehicle, prosecution is unlikely to succeed if (for example) you were in your PJs with the fridge on gas and a silver screen or blinds over the cab windows at the time you were breathalysed! You guys be nice!
Jackie is obviously new-ish to wildcamping hence the question in the first place.
I've never heard of anyone, ever, being 'done' for being p*ss*d in a parked up camper.
Sure there might be some smart*rse out there to jump in and make me a liar, but, personally speaking, I wouldn't worry about it one jot.
Thats strange as my uncle got done in the late sixties early seventies when pissed with the keys in his pocket and took them out to open the car in Bangor Co Down, the word likelihood does not wash when up in front of the wig.Being as Section 5(1)(2) of the Road Traffic Act 1988 creates a statutory defence of there being no likelihood of driving the vehicle, prosecution is unlikely to succeed if (for example) you were in your PJs with the fridge on gas and a silver screen or blinds over the cab windows at the time you were breathalysed!
I suspect that defence might not have been available in the the late sixties/early seventies since it was created by Section 5(1)(2) of the Road Traffic Act 1988. For that, it might still not be available in NI since there are differences between the various countries of the Union regards driving laws.Thats strange as my uncle got done in the late sixties early seventies when pissed with the keys in his pocket and took them out to open the car in Bangor Co Down, the word likelihood does not wash when up in front of the wig.
Yes maybe, also our police<RUC> in them days would arrest their Granny, the new PSNI are much more soft and stay out of sight unless called out for a good reason.I suspect that defence might not have been available in the the late sixties/early seventies since it was created by Section 5(1)(2) of the Road Traffic Act 1988.
